Terms Of Service

These Terms govern your use of proveclaim.app and app.proveclaim.app (the "Site") and any report you buy from 25 Fathoms, LLC ("ProveClaim," "we," "us"). By using the Site you agree to these Terms.

Who Can Use ProveClaim

You must be at least 18 years old and able to enter a binding contract. If you use the Site for a company or another person, you confirm you are authorized to act for them.

What ProveClaim Is

ProveClaim produces an independent commercial and valuation brief based on the patent claims and materials you provide. It is a structured, third-party judgment delivered as a report. You are responsible for how you use that report.

What ProveClaim Does Not Do

We do not find buyers or licensees for you, broker or negotiate a sale or license, introduce you to companies, or represent you to anyone. We do not take a fee, commission, or share of any deal you make. A report may name companies that could be a fit for your patent and suggest how you might approach them; you decide whether and how to contact anyone, and any deal is between you and that company. We are not a patent attorney or patent agent, and we do not represent anyone before the United States Patent and Trademark Office.

Not Legal Or Financial Advice

A ProveClaim report is not legal advice and is not financial advice. We are not your attorney, and we are not a licensed valuation professional. The freedom-to-operate and validity sections are directional only and are not a legal opinion. Where a report compares your claims to a company’s product or service, the comparison is a commercial screening read built from public information. It is not an opinion that anyone infringes your patent, and it is not an accusation against the company named. Consult qualified counsel and advisors before you act.

No Guarantee Of Outcome

We do not guarantee any license, sale, partnership, investment, or valuation result. Valuation ranges are estimates with a stated basis, not promises.

Your Account

You are responsible for the accuracy of your account details and for keeping your sign-in secure. You are responsible for activity that happens under your account. Tell us promptly at hello@proveclaim.app if you believe your account has been used without your permission.

Your Materials

You confirm you have the right to share the filing materials you submit. You keep ownership of your materials. You grant us the limited right to use them to produce your report and to support and stand behind that report.

Confidentiality Of Your Filing

We treat the filing materials you submit as confidential, as described in our Privacy Policy. We do not sell them and we do not share them with third parties for their own use. This does not apply to information that is already public, such as an issued or published patent, or that we are required to disclose by law.

Acceptable Use

Do not use the Site to break the law, infringe the rights of others, or interfere with the Site's operation. Do not scrape the Site, reverse engineer it, or use it to build a competing product or service.

Payment And Refunds

Prices are shown on the Site. Fees for a report are due as stated at checkout. A Snapshot may be offered at no cost. You may cancel a paid report for a full refund at any time before we deliver it.

Our Accuracy Guarantee

Every figure in a report comes with its stated basis. If a figure in your delivered report has no stated basis, or a fact in it is wrong, tell us and we will fix the report at no charge. If we cannot fix it, we will refund what you paid for that report. Apart from this guarantee and the cancellation right above, a delivered report is not refundable.

Our Intellectual Property

The report and its structure, method, and presentation remain our intellectual property. You may use and share the report for your own monetization purposes. You may not resell the report or our method as a service.

Feedback

If you send us feedback or suggestions, we may use them to improve ProveClaim without any obligation to you.

Third-Party Services

The Site relies on third-party services such as payment, hosting, authentication, and AI providers, including Anthropic, which provides the AI models used to help produce reports. We are not responsible for those third parties, and your use of them may be subject to their own terms.

Disclaimers

The Site and reports are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the extent the law allows. We do not warrant that the Site will be uninterrupted or error free.

Limitation Of Liability

To the extent the law allows, our total liability for any claim related to the Site or a report is limited to the amount you paid for that report. We are not liable for indirect, incidental, special, or consequential damages.

Indemnification

You agree to defend and hold us harmless from claims arising out of your materials, your use of a report, or your breach of these Terms, to the extent the law allows.

Suspension And Termination

We may suspend or end your access to the Site if you breach these Terms or use the Site in a way that could harm us or others. You may stop using the Site at any time and may ask us to delete your account.

Governing Law And Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Hamilton County, Ohio, and you consent to their jurisdiction.

Changes To These Terms

We may update these Terms. Continued use of the Site after an update means you accept the current version.

Miscellaneous

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us about the Site.
